1. Acceptance of Terms
By accessing or using glamth.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. You must be at least 18 years old to use the Platform.
2. About the Platform
Glamth is a peer-to-peer marketplace for buying and selling beauty products. We provide the technology platform that connects buyers and sellers — we are not a party to transactions between users. Glamth does not own, inspect, or guarantee any items listed on the Platform.
3. Accounts
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information when creating your account.
- One person may operate only one account.
- You are responsible for all activity under your account. Notify us immediately at support@glamth.com if you suspect unauthorized access.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Listing and Selling
Seller Responsibilities
- You must accurately describe the condition, brand, and authenticity of items you list.
- All listed items must be genuine beauty products. Counterfeit items are strictly prohibited and will result in immediate account termination.
- Items must comply with all applicable laws and regulations, including FDA guidelines for cosmetics.
- Used items must clearly disclose usage level. Products that are expired, recalled, or damaged in ways not disclosed are prohibited.
- You must ship sold items within 5 business days of receiving payment confirmation.
Prohibited Items
- Counterfeit or knockoff products
- Expired products (past manufacturer expiration date)
- Products recalled by the manufacturer or FDA
- Prescription skincare or medications
- Homemade or unlabeled cosmetics without proper safety testing
- Items that infringe on intellectual property rights
5. Buying
- When you purchase an item, you enter a binding transaction with the seller. Payment is processed by Stripe.
- You must provide a valid shipping address at the time of purchase.
- Review items promptly upon receipt. If an item is significantly not as described, you may open a dispute within 3 days of delivery.
6. Fees and Payments
- Glamth charges a platform fee on each completed transaction. The current fee structure is displayed before listing and at checkout.
- Sellers receive payouts via Stripe Connect after order completion.
- All prices are in USD. Sellers set their own prices; Glamth does not control pricing.
- Platform fees are non-refundable except in cases of full refund due to a resolved dispute.
7. Auctions
- Bids are binding commitments to purchase at the bid price.
- The highest bidder at auction close wins, provided the bid meets or exceeds any reserve price set by the seller.
- Auctions may include anti-snipe extensions: bids placed in the final 2 minutes extend the auction by 2 minutes.
- Bid manipulation, shill bidding, and bid retraction are prohibited.
8. Disputes and Refunds
- If an item is significantly not as described, damaged in transit, or not received, you may open a dispute through the Platform.
- Both parties have the opportunity to provide evidence. Glamth administrators will review disputes and may issue full refunds, partial refunds, or dismiss the dispute.
- Glamth's dispute resolution decision is final for transactions on the Platform. This does not limit your rights under applicable consumer protection laws.
9. Seller Strikes and Enforcement
- Sellers who violate these Terms may receive strikes (warnings, suspensions, or bans).
- Serious violations — counterfeit items, fraud, harassment — may result in immediate permanent ban without prior warning.
- Banned sellers forfeit pending payouts subject to applicable law.
10. Intellectual Property
All Glamth branding, logos, and Platform design are our property. User-generated content (listings, photos, reviews) remains your property, but you grant Glamth a non-exclusive, royalty-free license to display it on the Platform and in marketing materials.
11. Limitation of Liability
Glamth provides the Platform "as is" without warranties of any kind. To the maximum extent permitted by law, Glamth is not liable for: the quality, safety, or legality of items listed; the accuracy of listings; the ability of sellers to sell or buyers to pay; or any damages arising from use of the Platform. Our total liability for any claim is limited to the fees you paid to Glamth in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold Glamth harmless from any claims, losses, or damages arising from your use of the Platform, your violation of these Terms, or your violation of any third party's rights.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
14. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via the Platform or email. Continued use after changes constitutes acceptance. If you disagree with updated Terms, you must stop using the Platform.
